Transparency Law

Introduction

By means of this document, the following companies comply with the provisions regarding TRANSPARENCY, as per the Transparency Law regulated by the Canary Law 12/2014 and the State Law 19/2013. The Canary Law 12/2014 includes in article 3.1, letter b) private companies or entities that receive more than 60,000 euros annually in public aid as subjects covered within its scope of application; as does the basic state norm (Law 19/2013), by establishing a set of informational obligations more limited than those contemplated in the Canary norm or other regional ones. The Transparency Law of the Canary Islands indicates that “the commissioner is obliged to present an annual report to the Parliament of the Canary Islands on the application and fulfillment of the transparency obligations by the various public and private entities of the Autonomous Community, with the minimum content outlined in the law.” And in article 64, it is determined that private entities “must provide the commissioner for Transparency and Access to Public Information with the information requested and provide the necessary collaboration for the development of their functions. Specifically, they must keep detailed information on the degree of application of the law in their respective areas of competence up-to-date and available.

It is a body created by the Transparency Law of the Canary Islands and dedicated to promoting, analyzing, controlling, and protecting transparency and the right of access to public information in the Canary Islands. In exercising the functions granted to it by Law 12/2014, of December 26, on transparency and access to public information, it must act with autonomy and full independence. The regulation of this body is outlined in Title IV of the aforementioned Law. The Commissioner for Transparency is granted various powers, among which two main ones stand out: monitoring compliance with the obligation to publish the information listed in Title II of the Law by the bodies and entities subject to it (known as “active publicity”); and resolving claims filed by citizens against the express or presumed rulings on requests for access to information from the entities and bodies included within the scope of the Transparency Law of the Canary Islands.
